  • Payment Operator: ING Bank Śląski S.A. with its registered office in Katowice, ul. Sokolska 34, 40-086 Katowice, entered in the register of entrepreneurs of the National Court Register kept by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0000005459, NIP 634-013-54-75, REGON 271514909, share capital PLN 130,100,000, paid in full.

§3. Technical requirements

Using the Shop requires a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active e-mail address. Buying in the Shop does not require an account. The Customer may not provide unlawful content to the Shop.

§4. Placing orders and conclusion of the contract

  1. Orders can be placed 24 hours a day, seven days a week. Orders are fulfilled on business days.
  2. To place an Order, the Customer adds Goods to the basket, goes to checkout, enters the details needed to fulfil it (name, e-mail address, phone number and delivery address), chooses the delivery and payment method, accepts these terms and then clicks the “Zamawiam i płacę” (order with obligation to pay) button.
  3. Before placing the Order, the Customer sees the total price of the Goods including delivery costs.
  4. Clicking the “Zamawiam i płacę” button means placing an Order with an obligation to pay.
  5. After placing the Order, the Customer receives an e-mail confirming that it has been accepted. The sales contract is concluded when this e-mail is received.

§5. Prices and payment

The Customer can pay for an Order:

  • online, through the ING Pay Payment Gateway: with a BLIK code, a fast online bank transfer (pay-by-link), a Visa or Mastercard payment card, or with Google Pay or Apple Pay,
  • on personal collection at the Seller’s studio: in cash, by Visa or Mastercard payment card, with a BLIK code or with Google Pay or Apple Pay,
  • cash on delivery, to the courier when the parcel is delivered (delivery method “Kurier za pobraniem”).
  1. Prices in the Shop are gross prices in Polish zloty (PLN). Delivery costs are shown separately, before the Order is placed.
  2. The payment methods available for an Order are shown while it is being placed and depend on the chosen delivery method.
  3. An Order paid online is paid immediately after it is placed. An online payment is considered made when the Seller receives confirmation of its successful execution from the Payment Operator. An unpaid Order may be cancelled.
  4. The Customer enters payment card details and online banking login details only with the Payment Operator or their own bank. The Seller does not receive this data.
  5. The availability of Google Pay and Apple Pay depends on the Customer’s device and browser.
  6. The Seller issues a proof of purchase for every Order. A Customer who wants an invoice gives the invoice details (including the tax ID) in the Order notes.

§6. Delivery

  3. We dispatch an Order on the business day on which it was placed, and an Order paid online on the business day on which the payment arrived. An Order placed on a non-working day or after the studio’s opening hours is dispatched on the next business day. Within the same time, an Order for personal collection is ready to be collected at the studio.
  4. The carrier usually delivers the parcel within 1-2 business days of dispatch.
  5. Personal collection is possible at the studio at al. Niepodległości 87/37, 43-100 Tychy, during opening hours: Monday to Friday 7:00-18:00, Saturday 9:00-14:00.

§7. Right of withdrawal

  1. A Consumer and a Sole trader with consumer rights may withdraw from the sales contract within 14 days without giving any reason and without incurring costs, except those set out in points 5 and 6. The period runs from the day on which the Customer, or a third party other than the carrier indicated by them, takes possession of the Goods.
  2. To withdraw, it is enough to send the Seller an unequivocal statement before the period expires, for example by e-mail to salonfoto@gmail.com or in writing to the studio’s address. The model withdrawal form (in Polish) may be used but is not mandatory. The Seller confirms receipt of the statement by e-mail without delay.
  3. The Seller refunds all payments received, including the cost of delivering the Goods (except for additional costs resulting from a delivery method chosen by the Customer other than the cheapest standard delivery method offered by the Seller), without undue delay and no later than 14 days after receiving the statement of withdrawal. The refund uses the same payment method the Customer used, unless the Customer expressly agrees to another method that involves no costs for them. The Seller may withhold the refund until the Goods have been received back or proof of their return has been supplied, whichever comes first.
  4. The Goods should be sent to Salonfoto.com, al. Niepodległości 87 lok. 37, 43-100 Tychy, Poland, or brought to the studio without undue delay and no later than 14 days after withdrawal.
  5. The Customer bears the direct costs of returning the Goods.
  6. The Customer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning. A film taken out of its box and foil, loaded into a camera or exposed can no longer be resold.
  7. The right of withdrawal does not apply in the cases listed in Article 38(1) of the Polish Consumer Rights Act of 30 May 2014, in particular to Goods made to the Customer’s specifications or clearly personalised.
  8. More information: Returns policy (in Polish).

§8. Complaints

  1. Towards a Consumer and a Sole trader with consumer rights, the Seller is liable for the conformity of the Goods with the contract under Article 43a et seq. of the Polish Consumer Rights Act of 30 May 2014, and towards other Customers under the statutory warranty of the Civil Code.
  2. A complaint can be made by e-mail to salonfoto@gmail.com, in writing to the studio’s address or in person at the studio. It helps to include the Order number, a description of the non-conformity and when it was found, the request (repair, replacement, price reduction or withdrawal from the contract) and contact details.
  3. The Seller responds to a complaint within 14 days of receiving it.
  4. The Seller bears the costs of delivering the Goods in connection with a justified complaint.
  5. Complaints about online payments, for example a double charge, can be made in the same way. If a complaint concerns the operation of the Payment Gateway, the Seller forwards it to the Payment Operator. The Customer can also complain directly to the Payment Operator or to their own bank.
  6. Details: complaint conditions (in Polish).

§9. Out-of-court complaint and redress procedures

A Consumer may use out-of-court complaint and redress procedures, in particular ask for help from the district (municipal) consumer ombudsman, a consumer organisation or the Provincial Inspectorate of Trade Inspection in Katowice. Information about these procedures is available at https://prawakonsumenta.uokik.gov.pl.

§10. Personal data

  1. The controller of Customers’ personal data is the Seller. The rules for processing personal data are set out in the Privacy Policy. For matters concerning personal data, write to salonfoto+rodo@gmail.com.
  2. Data is processed to fulfil the Order and the sales contract (Article 6(1)(b) GDPR), to meet legal obligations, in particular tax and accounting obligations (Article 6(1)(c) GDPR), and to establish, pursue or defend claims (Article 6(1)(f) GDPR).
  3. The Seller passes the data needed for delivery to the carrier (InPost or a courier company) and the data needed for online payment to the Payment Operator, which processes it as a separate controller.

§11. Final provisions

  1. These terms apply from 24 September 2026.
  2. The Seller may change these terms for important legal, organisational or technical reasons. Orders placed before a change are governed by the terms in force on the day the Order was placed.
  3. Nothing in these terms limits the rights of a Consumer or a Sole trader with consumer rights under mandatory provisions of law.
  4. Matters not covered by these terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act of 30 May 2014 and the Act on Providing Services by Electronic Means of 18 July 2002.
